Maternity benefit
Female students who are in dependent employment are entitled to maternity benefit. A distinction is made between two initial situations:
- Students who are in dependent employment and are insured as members of a statutory health insurance fund are entitled to maternity benefit for the duration of the protection periods six weeks before and eight weeks (twelve weeks in the case of multiple births) after the birth. The decisive factor for entitlement is that the employment relationship exists at the beginning of the maternity protection period or that it begins during the protection period or has been permissibly terminated during the pregnancy. The type and scope of the employment relationship are not decisive for the entitlement to maternity benefit; temporary or marginally paid employment also applies here. During the maternity protection period, the woman receives maternity benefit of €13 per calendar day from the statutory health insurance fund. If the average net wage of the last three months before the protection period exceeds the maximum daily rate of €13, the employer is obliged to pay the difference to the net wage as a supplement to the maternity benefit. Applications for maternity benefit are submitted to the relevant statutory health insurance fund.
Students who are members of a statutory health insurance fund and whose employment relationship exists at the beginning of the maternity protection period therefore receive maternity benefit in the amount of their net salary.
- Students receive maternity benefit up to a maximum (one-off) amount of €210 if they are employed at the beginning of the maternity protection period, i.e. six weeks before the birth, and are not themselves members of a statutory health insurance fund. The informal application must be sent to the Federal Social Security Office together with the calculated date of delivery:
