Child be­ne­fit

German parents who are resident or ordinarily resident in Germany are entitled to child benefit. Citizens of the European Union, the European Economic Area and Switzerland can also receive child benefit in Germany under certain conditions. Foreign nationals living in Germany can receive child benefit if they have a settlement permit. Certain other residence permits can also trigger an entitlement to child benefit. International students who only have a residence permit for the purpose of studying do not receive child benefit for their children.

Not only biological children are taken into account, but also adopted children, foster children, stepchildren and grandchildren, provided they live permanently in the household of their parents, adoptive parents, grandparents or foster parents. Child benefit is paid for all children up to the age of 18, beyond that only under certain conditions. For children who have already reached the age of majority, child benefit is paid until they reach the age of 25 if they are in education, which also includes studying (but not during the period in which studies were interrupted due to pregnancy and child rearing).

Child be­ne­fit & leave of ab­sence

In principle, students on leave of absence are not entitled to child benefit for themselves (this does not apply to their children). Child benefit is generally paid for a student on leave of absence due to pregnancy until the end of the maternity protection period. However, if studies are continued in the semester following the leave of absence, the period from the end of the maternity protection period (eight weeks after the birth) to the start of the semester can be recognised as a transitional period if it lasts a maximum of four months (Federal Tax Gazette Part 1, No. 14 of 12.08.1996).

In principle, both parents are entitled to half of the child benefit. Child benefit is generally paid to the parent in whose household the child lives. Child benefit is paid monthly. Applications for child benefit are submitted to the family benefit offices of the relevant employment agencies. This requires the completed child benefit application form and the birth certificate. Foreign applicants also need their passport.
